Scope of application
These conditions of participation regulate the conditions for the publication of contributions with pictures, audio and video on THW Stories. The platform is operated by the state capital Kiel.
Conditions of participation
Every user may publish contributions with images, audio and video on the platform, provided that he/she has previously registered on the platform and has accepted these conditions of participation.
Rights to the contributions
By publishing a contribution on the platform, the user grants the operator the right to publish and distribute the contribution permanently on the platform. The user guarantees that he/she has all the necessary rights to publish the contribution on the platform, in particular that he/she has the copyrights and other protective rights to the images, audios and videos.
Indemnification from claims of third parties
The user indemnifies the operator against all claims of third parties which are asserted in connection with the publication of the contribution on the platform. In particular, the user guarantees that the images, audios and videos are free of third party rights and that no third party rights are infringed by their publication on the platform.
Removal of contributions
The operator reserves the right to remove contributions that violate these conditions of participation or violate legal regulations. In particular, contributions that violate the rights of third parties or offend common decency will be removed.
Liability of the user
The user is liable for all damages caused by the violation of these conditions of participation or by the publication of a contribution on the platform. The user shall indemnify the operator against all claims of third parties asserted in connection with the violation of these conditions of participation or the publication of a contribution on the platform.
Changes to the conditions of participation
The operator reserves the right to change these conditions of participation at any time. The amended conditions will be communicated to the user by e-mail or other suitable means. The user has the right to object to the amended conditions within a period of four weeks after notification. If the user does not object within this period, the amended terms and conditions shall be deemed accepted.
Final provisions
These conditions of participation are subject to German law. The place of jurisdiction is Kiel. Should individual provisions of these conditions of participation be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic sense and purpose of the invalid provision.
The Terms and Conditions of Participation constitute the entire agreement between the Participants and the Organiser and supersede any prior agreements or understandings made between the parties. Any amendments or additions to these Conditions of Participation must be made in writing.
The Promoter reserves the right to amend or supplement these Terms and Conditions of Participation at any time without stating reasons, provided that this is necessary in the interests of the simple and safe operation of the competition or a change is made due to circumstances beyond the Promoter's control.
Should individual provisions of these terms and conditions of participation be invalid in whole or in part, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the valid provision that comes closest to the economic purpose of the invalid provision shall be deemed agreed.
